Identify his hazardous waste:
To do so, he presents the method of the only classification of the decree of April 18th, 2002, codified in the Art. R541-7 to R541-11 of the environment Code: a unique list for all the waste (dangerous and non-hazardous) the " European Catalog of the Waste ", the waste identified by a 6-digit code - their CED codes - , and hazardous waste indicated by an asterisk (*).
He also reminds the requirements of the Code of environment: the obligation to insure the elimination of the waste in staturory conditions and allowing to avoid the harmful effects on the health of people and the environment falls to the producer (or holder) of waste Book V - Title IV, law of 1975. The producers also have to make sure that the person receiving are authorized in conformance with the classified Installations for the environmental protection ( ICPE) to insure the transit and the treatment of the waste which are given to him; but also to hold a valid Certificate of preliminary acceptance (CAP) before the removal of the waste and finally, to insure the transparency and the traceability.
Fabrice Bertolini indicates then how to fill out exhaustively the regulatory cards: during the orders or during the establishment of CAP and FID and as well the documents of traceability and transport (BSD). On this subject, he adds that it is indispensable to make sure that hazardous materials are authorized for the transport according to the ADR and clearly identified (packaging, labeling) for the transport, by a UNO code and an official name, classified dangerous in conformance with the European Agreement concerning the international transport of the dangerous goods by road according to its main danger (= class of danger) for the transport and possess possibly supplementary dangers.
Generally, we attribute, to the materials a group of packaging (GE), except for the classes 1, 2 and 7 and certain specific goods:
GE I: very dangerous Material / GE II: averagely dangerous Material / GE III: weakly dangerous Material. Mixtures or chemically unstable materials are forbidden for transport, it is necessary to stabilize them on the spot, before all movement. Besides, from January 1st, 2010, the waste of n UNO 3077 and 3082 must be indicated by a new 10 by 10cm label. Attention, there is no direct link between the code CED and the code UNO, certain dangerous classified waste in conformance with the Code the environment can, for example, not be subjected to the ADR.
In conclusion, the speaker focuses on some points: to assure the conformity and the safety of the sorting, the storage, the transport and the treatment, the producer and the sender of the waste have to identify their hazardous waste and to provide the indispensable information to their people receiving benefits:
- During the orders or during the establishment of CAP
- At the level of the labeling of packaging
- At the level of the documents of traceability and transport ( BSD)
Finally, he warns the producer (and the sender) that a delegation of its obligations does not exempt him from its responsibility, from the identification and from the classification. He thus has to make sure of the quality and the respect for the procedures by the various participants.
